Terms of Service

In case of conflict between translations, the Portuguese version prevails.
1. Service Provider & Nature of Service
MyClub is operated by FABWIND LDA, Portugal (NIF: PT516581716). MyClub is a technology platform only — a digital tool that enables users to coordinate cycling activities, record GPS data, and share content within private groups. We do not organise, supervise, or conduct any ride, route, or event. All rides and routes are created entirely by users.
2. User-Generated Content & Routes
All content on MyClub — including rides, routes, segments, leaderboards, photos, and group descriptions — is created by users, not by the Provider. We do not verify the safety, legality, accuracy, or suitability of any user-generated content. Users who propose rides or create routes are solely responsible for their content.
3. Assumption of Risk
YOU EXPRESSLY ACKNOWLEDGE THAT CYCLING CARRIES INHERENT RISKS OF PROPERTY DAMAGE, BODILY INJURY, OR DEATH.
These risks include traffic collisions, falls, equipment failure, adverse weather, road hazards, and the actions of other riders or third parties.
BY USING MYCLUB, YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH YOUR ATHLETIC ACTIVITIES.
4. What MyClub Is NOT
- (a) An emergency service — SOS and crash detection are peer-to-peer communication aids. They do NOT contact 112/911. ALWAYS CALL 112 DIRECTLY.
- (b) A navigation system — routes are informational, not guaranteed safe or accurate.
- (c) A medical device — crash detection uses consumer-grade phone sensors only.
- (d) A tracking guarantee — GPS positions are approximate (±10–50m).
- (e) A device sync guarantee — route delivery to Garmin/Wahoo depends on third-party APIs.
5. SOS & Crash Detection
These are community communication aids between users — nothing more.
5.1 SOS Alert
The SOS button sends an alert with your approximate GPS location to club members via push notification. It is a best-effort communication aid.
5.2 Crash Detection
MyClub uses phone sensors to detect patterns consistent with a cycling incident. A 60-second countdown allows you to cancel. If no response, alerts are sent to emergency contacts and club captains.
What it does NOT do: contact emergency services, guarantee detection, guarantee delivery, prevent injury, provide medical assessment, or replace calling 112/911.
5.3 Limitations
- False positives: May trigger from dropping phone, potholes, sudden braking.
- False negatives: May fail to detect actual incidents. Never rely on this solely.
- Network: Alerts require cellular data. Rural areas may have no coverage.
- GPS accuracy: ±10–50m or more, subject to signal quality.
- Delivery: Push notifications may be delayed by device settings, battery optimisation, or OS restrictions.
5.4 Your Responsibilities
ALWAYS call 112 or 911 directly if you need emergency assistance. Do not rely solely on MyClub for emergency communication.
6. Ride Proposer Responsibilities
The rider who proposes a ride is solely responsible for selecting appropriate routes and communicating risks. The Proposer is NOT an agent of the Provider.
7. Segments & Leaderboards
Segments are informational features, NOT races or competitions. The Provider does not encourage users to exceed speed limits or take risks for faster times.
8. Group Administration
Group Admins are solely responsible for their group's conduct and are NOT agents of the Provider.
9. Limitation of Liability
THE PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
MAXIMUM AGGREGATE LIABILITY: THE GREATER OF €50 OR TOTAL FEES PAID IN THE PRECEDING 12 MONTHS.
EU consumer rights are fully preserved.
10. Indemnification
You agree to indemnify the Provider from claims arising from your use of the platform, athletic activities, content you create, or violation of these terms.
11. Third-Party Services
MyClub integrates with Garmin, Wahoo, Strava, and others governed by their own terms. The Provider is not responsible for third-party availability or functionality.
12. Acceptable Use
Do not: create dangerous segments, harass users, use the platform illegally, reverse-engineer the platform, or upload harmful content.
13. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
14. Modifications
We may update these terms at any time. Material changes will be communicated via the app or email.
15. Termination
We may suspend accounts for violations. You may delete your account at any time.
16. Governing Law
Portuguese law. Courts of Viseu, Portugal. EU consumer rights preserved.
17. Premium Subscriptions
- Pricing: €5.99/month or €39.99/year. Prices may change with 30 days' notice.
- Free trial: 30 days. No payment method required.
- Billing: Via Stripe. Auto-renews unless cancelled.
- Cancellation: Anytime from settings. No partial refunds.
18. Advertising
Free users may see non-personalised ads (Google AdMob). Never during rides or over safety features. Premium = ad-free.
19. Severability
If any provision is unenforceable, the rest remains in effect.
20. RideReel — Video Content
By accepting RideReel consent, you grant the Provider a non-exclusive, worldwide, royalty-free license to store, process, and distribute your footage for segment previews and route guides. You retain ownership. Consent can be revoked in Settings.
